His Majesty the Emperor appoints the Prime Minister as designated by the Diet and the Chief Justice of the Supreme Court as designated by the Cabinet.

In the case of appointment of the Prime Minister, the Speaker of the House of Representatives and the President of the House of Councillors are present. His Majesty the Emperor gives the address to make the appointment of the Prime Minister. After that the letter of appointment is conveyed from the former Prime Minister.

In the case of appointment of the Chief Justice of the Supreme Court, after His Majesty the Emperor makes the appointment, the letter of appointment is conveyed from the Prime Minister.
